Terms of use
1. Agreement
These terms are an agreement between you and [OPERATOR NAME] ("we", "us") about your use of the PriceWarden app, its server and this website. The app asks you to accept them before you use your account. If you do not agree, do not use PriceWarden. The privacy policy explains how we handle your information and forms part of these terms.
2. What PriceWarden is
PriceWarden is an information service. It looks up a product, finds offers for it from stores and price data services, estimates what each offer would cost you in total, and lets you keep a watchlist with alerts.
We do not sell the products shown. Every purchase is made with the store, on the store's terms, and the store is responsible for the product, its delivery, returns and warranty.
3. Prices and true totals are estimates
- Offers, prices, shipping costs and stock come from stores and third-party data services. They can be incomplete, out of date or wrong, and a price can change between our last check and your visit.
- A true total adds the price, estimated shipping, the sales taxes for the province you entered and, for stores outside Canada, estimated duties and a currency conversion at the Bank of Canada's most recent published daily rate. Your bank or card issuer may use a different rate and add fees.
- PriceWarden shows the offers it can find, not every offer that exists.
- The price and total at the store's checkout are the ones that apply. Check them before you buy.
4. Price match cards
A price match card shows an offer and a summary of a store's price match policy as we last checked it, with the date of that check. Stores write and change their own policies, and the store alone decides whether to match a price. We do not promise that any store will accept a card.
5. Your account
- You sign in with a one-time code sent to your email address. Keep access to that mailbox secure, because anyone who can read it can sign in as you.
- You must be at least 13 years old to have an account.
- Your account is for you alone. Give a province and postal code that are yours, since true totals depend on them.
- You can delete your account at any time, as described on the delete-account page.
6. Plans and billing
- The free plan costs nothing. Paid plans are monthly subscriptions sold by Apple through the App Store and by Google through Google Play, under their terms. The app shows what each plan includes and its price before you buy.
- A subscription renews automatically until you cancel it in your App Store or Google Play account settings. Deleting your PriceWarden account does not cancel it.
- Refunds are handled by Apple or Google under their policies; we cannot issue them.
- When a subscription ends or is refunded, your account returns to the free plan.
7. Watchlist slots
Each plan includes a number of watchlist slots. One saved product takes one slot.
- When your watchlist is full, you cannot add another product until you delete one or move to a plan with more slots.
- If you move to a plan with fewer slots, nothing is deleted. Your oldest entries, up to the new number of slots, stay active. The newer entries beyond that number become read-only: you can still see them and delete them, but you cannot change them and they send no alerts.
- Deleting an entry frees a slot, and the oldest read-only entry becomes active again. Moving to a plan with more slots makes read-only entries active again automatically.
8. Alerts
We check prices on a schedule and send the alerts you set up when the conditions you chose are met. Alerts depend on third-party data, email delivery and, where used, push services, so an alert can arrive late or not at all, and the price may have changed by the time you read it. Do not rely on PriceWarden as your only way of tracking a price that matters to you. You can turn alerts off in the app, and every alert email has a one-step unsubscribe link.
9. Affiliate links
Some links to stores earn PriceWarden a commission when you buy through them. This costs you nothing extra, and it never changes how offers are ranked. See the affiliate disclosure.
10. Acceptable use
You agree not to:
- access PriceWarden's server other than through the app, or use scripts, bots or scrapers to collect its data;
- copy, resell or republish PriceWarden's data, or build a competing database from it;
- probe, overload or interfere with the service, or try to get around plan limits or security;
- use PriceWarden for anything unlawful, or to harm others.
We may suspend or close an account that breaks these rules.
11. Content and trademarks
We grant you a personal, non-transferable licence to use the app for your own non-commercial shopping. Product names, images, store names and trademarks shown in PriceWarden belong to their owners and are shown only to identify products and offers; their appearance does not mean those owners endorse PriceWarden.
12. Changes to the service
We may change, add or remove features, data sources and stores. We may also stop the service. If we stop it, we will tell you in the app or by email at least 30 days in advance where we can.
13. No warranty
To the extent the law allows, PriceWarden is provided "as is" and "as available", without any promise that it is accurate, complete, uninterrupted or fit for a particular purpose.
14. Limitation of liability
To the extent the law allows, we are not liable for any loss arising from a price, total, alert, price match card or offer shown in PriceWarden, from a purchase you make from a store, or from anything a store does. Our total liability to you for any claim is limited to the amount you paid for PriceWarden in the 12 months before the claim.
Nothing in these terms limits any right you have under consumer protection law that cannot be limited by agreement.
15. Changes to these terms
When these terms change, we will post the new version here with a new date, and the app will ask you to accept it before you continue using your account. If you do not accept it, you can delete your account.
16. Governing law
These terms are governed by the laws of Canada and of the province in which [OPERATOR NAME] is based, without limiting the protection given to you by the consumer protection law of the province where you live.
